Online store www.tuningovesvetla.sk
These general terms and conditions (hereinafter the “terms and conditions”) govern the rights and obligations of the contracting parties arising from a distance purchase contract concluded between the seller and the buyer through the online store at www.tuningovesvetla.sk (hereinafter the “online store”).
The seller is the operator of the online store identified in Article II.
The buyer is a natural or legal person who has submitted an order through the online store.
A consumer is a natural person who, when concluding and performing the purchase contract, is not acting within the scope of their business activity, employment or profession.
Contractual relations between the seller and the buyer are governed by the law of the Slovak Republic, in particular Act No. 108/2024 Coll. on Consumer Protection, Act No. 40/1964 Coll., the Civil Code, Act No. 22/2004 Coll. on Electronic Commerce, Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes and other generally binding legal regulations of the Slovak Republic. In relation to a buyer who is not a consumer, the relevant provisions of the Commercial Code apply; the application of the UN Convention on Contracts for the International Sale of Goods is excluded. If the buyer is a consumer habitually resident in another Member State of the European Union, the choice of Slovak law does not deprive them of the protection afforded by the provisions of the law of their country of habitual residence that cannot be derogated from by agreement (Article 6(2) of Regulation (EC) No 593/2008 – Rome I), for example where that law provides for a longer liability period for defects.

The buyer creates an order by completing and submitting the order form in the online store: they add goods to the cart, enter their contact and delivery details at checkout, choose the shipping and payment method, check the order summary and submit the order with the “Order with obligation to pay” button (for card payment, “Order and pay by card”), thereby acknowledging the obligation to pay the purchase price. Before submitting the order, the buyer sees on the checkout page all the details entered and the chosen shipping and payment method, and in the order summary the individual items, the shipping cost, any cash-on-delivery surcharge and the total price. During this check the buyer can identify input errors and correct them directly in the form fields; items and quantities can be changed in the cart (“Edit cart” link). The form marks any missing required details before submission. By submitting the order, the buyer confirms that they have read these terms and conditions and that they agree to them.
The order is a proposal to conclude a purchase contract. Without undue delay after receiving the order, the seller sends the buyer an order confirmation to the buyer’s e-mail address. The purchase contract is concluded when this confirmation is delivered to the buyer; if it is not delivered, the purchase contract is concluded no later than when the goods are dispatched. The order confirmation includes, as attachments, these terms and conditions, the complaints procedure and the information on the right of withdrawal with the model withdrawal form, in the wording in effect at the time the order was submitted, so that the buyer can store them and reproduce them unchanged at any time.
The seller stores the concluded contract (the order details and the order confirmation including the documents attached to it) electronically; the contract is not publicly accessible. The buyer has it in the order confirmation e-mail, and the seller will send it again on request. The contract can be concluded in Slovak or in English; it is concluded in the language of the version of the online store in which the buyer submitted the order (the English version is available at www.tuningovesvetla.sk/en). These terms and conditions, the complaints procedure and the information on withdrawal from the contract are drawn up in Slovak and in English, and both language versions are equally valid. If the language versions differ or their meaning is unclear, the interpretation more favourable to the consumer applies; in relation to a buyer who is not a consumer, the Slovak version prevails. The seller sends the order confirmation and other e-mails about the order in Slovak and handles after-sales service, including complaints, in Slovak; if the buyer writes in English, the seller will try to reply in English where possible. It attaches the documents referred to above in Slovak and, for delivery outside the Slovak Republic and the Czech Republic, also in English. The English version is always available at www.tuningovesvetla.sk/en/terms, www.tuningovesvetla.sk/en/complaints and www.tuningovesvetla.sk/en/returns.
The buyer may cancel the order by e-mail or phone until the goods have been dispatched; this does not affect the consumer’s right to withdraw from the contract under Article IX. The seller may withdraw from the purchase contract if (a) the goods cannot be delivered (e.g. because they are out of stock at the supplier), (b) in the case of payment in advance, the buyer does not pay the purchase price within the period set out in Article V, or (c) the buyer does not collect goods ready for personal pickup within the period set out in Article VI. The seller will inform the buyer of the withdrawal by e-mail without undue delay and will refund everything it has received from the buyer under the contract (the purchase price and any delivery costs) without undue delay, no later than 14 days from the withdrawal, using the same means of payment the buyer used, unless agreed otherwise.
The prices stated in the online store are final and include VAT. For lights and other parts fitted in pairs, the price shown with a product applies to a pair (left and right piece), unless the product name or description expressly states otherwise (e.g. “left”, “right”, “1 pc”). The price does not include shipping costs, which are stated separately in accordance with Article VI.
If the buyer purchases as a business (taxable person) and enters in the order its business name and a VAT identification number issued in another EU Member State, which the seller verifies as valid in the VIES system when the order is placed, and the goods are shipped from Slovakia by courier service (GLS or Packeta) to the same Member State that issued that VAT number, the supply is an intra-Community supply of goods exempt from VAT under Section 43 of Slovak Act No. 222/2004 Coll. on Value Added Tax. The price of the goods and shipping is then charged without VAT and the buyer accounts for VAT on the acquisition of the goods in its own Member State. For personal pickup, for delivery to Slovakia or to a Member State other than the one that issued the VAT number, and whenever the VAT number cannot be verified as valid when the order is placed, VAT is charged under Slovak law. The ordering process shows before the order is submitted whether the buyer pays the price with or without VAT, and the order confirmation also states it. At the seller’s request, the buyer must confirm receipt of the goods in the Member State of destination; if the information on which the VAT-free price was based proves to be incorrect, the buyer must pay the VAT to the seller.
The binding price is the price shown for the goods at the moment the order is submitted, which is also stated in the order confirmation.
The buyer may pay for the goods in the following ways:
Bank details for payment by transfer: IBAN SK38 0900 0000 0050 6790 9334, Slovenská sporiteľňa, a.s. As the variable symbol (payment reference), the buyer states the order number.
If the purchase price is not paid in advance within the period (3 days for card payment, 7 days for bank transfer from submitting the order, always counted in 24-hour periods), the seller will warn the buyer by e-mail, usually 2 days and at least 1 day before cancelling the order. If the payment has still not arrived after the period expires, the seller may withdraw from the purchase contract (cancel the order); the seller informs the buyer of this by e-mail and returns the reserved goods to sale. A payment credited after the order has been cancelled will be refunded without undue delay unless the seller and the buyer agree to restore the order.
Goods that are in stock are dispatched (handed over to the carrier) by the seller, as a rule, on the business day after the order is submitted, if it is submitted by 10:00 on a business day; for orders submitted later or on a non-business day, one business day later (i.e. as a rule within 2 business days). Goods that the seller holds in its own warehouse in Trstená are, as a rule, dispatched on the day of an order submitted by 10:00 on a business day. In the case of payment in advance, the goods are dispatched after the payment is received. Within Slovakia, the goods are delivered by the GLS courier service to the buyer’s address or to a GLS pickup point (ParcelShop or parcel locker) chosen by the buyer; GLS usually delivers the shipment on the business day after dispatch (delivery to other EU Member States is governed by the section “Delivery to European Union member states” below). For in-stock goods ordered by 10:00 on a business day, delivery therefore usually takes place within 2 business days. The estimated delivery date, calculated from the current time and the selected shipping method, is shown to the buyer on the product page and in the ordering process before the order is submitted. A shipment delivered to a pickup point is held for collection by GLS for typically 5 business days at a ParcelShop and 2 business days in a parcel locker (GLS notifies the buyer of the delivery and the deadline by SMS or e-mail).
Bulky goods that do not fit into a standard courier shipment (in particular bumpers, body kits, fenders and hoods) are delivered by the TopTrans carrier; for such goods only this shipping method (or personal pickup) is available in the ordering process, payment is made in advance, and the delivery time is usually 2–5 business days. Some goods (mainly bulky ones) are shipped to the buyer directly by the seller’s supplier from Poland; such shipments are delivered by the supplier’s carrier (e.g. GLS, UPS or a pallet carrier), which usually contacts the buyer by phone before delivery. The seller informs the buyer of the carrier and the tracking number by e-mail upon dispatch.
Goods marked as “Available to order” are ordered by the seller from its supplier; the delivery time is usually up to 14 days from the conclusion of the contract. Unless agreed otherwise, the seller delivers the goods no later than 30 days from the conclusion of the contract.
The seller also delivers by courier to selected EU member states (the list of countries and the current shipping prices are stated on the Shipping and Payment page and in the ordering process). To Czechia, Hungary and Poland the shipment is delivered by the GLS courier; to the other Member States it is delivered by Packeta, which hands it over to its partner carrier in the country of delivery (e.g. PostNord, DHL or Colissimo). The shipping price abroad is determined according to the country of delivery (€11.90 to €22.90) and free shipping does not apply to these shipments. For deliveries outside the Slovak Republic, only payment in advance is available (by card or bank transfer); cash on delivery is not available. Only selected categories of goods are shipped abroad — front grilles, headlights, tail lights, fog lights, indicators and license plate lights; other goods (for example spoilers, diffusers, side skirts, bumpers, body kits, fenders and hoods) are delivered by the seller within Slovakia only. If the buyer chooses another country as the country of delivery, only personal pickup in Trstená is available for such goods. These restrictions depend solely on the place of delivery, not on the buyer’s nationality, place of residence or place of establishment; every buyer may have such goods delivered to an address in Slovakia under the same conditions. For selected products, the manufacturer or distributor restricts their sale to certain countries or abroad altogether; the ordering process will notify the buyer and will not allow delivery to the affected country. The delivery time abroad is usually 2 to 8 business days from dispatch depending on the country of delivery.
Personal pickup is possible at the seller’s pickup point at Oravická 617/20, 028 01 Trstená, during the opening hours Monday – Friday 9:00 – 15:00, at other times by arrangement. The goods can be collected only after the buyer receives an e-mail confirming that they are ready for pickup (for in-stock goods usually the next business day for orders submitted by 10:00 on a business day; with payment in advance only after the payment is received). With personal pickup, payment must be made in advance by card or bank transfer. The goods must be collected within 7 business days of the e-mail; if, with payment in advance, the purchase price has not yet been paid at that time, the period starts only when the payment is received. If the buyer does not collect them within this period and does not agree otherwise with the seller, the seller may withdraw from the contract (Article III); the seller will inform the buyer of the withdrawal by e-mail without undue delay and will refund all payments received from the buyer under the contract without undue delay, and in any event within 14 days of the withdrawal.
The goods offered in the online store (in particular headlights and other vehicle lighting, body parts and other car accessories) are spare parts and accessories for motor vehicles intended for professional installation. The goods are intended to be installed in the vehicle by a car service centre or another person with the appropriate professional qualification and equipment; they are not intended for self-installation by a buyer without professional knowledge.
Given this nature of the goods, no installation manual or user manual is supplied with the goods. The installation procedure is specific to each vehicle and follows the procedures prescribed by the vehicle manufacturer (removal of the original parts, connection to the vehicle’s wiring, headlight beam adjustment, etc.), which are known to a professionally qualified person. The main characteristics of the goods are stated in the product description in the online store; the seller will provide further information available to it, including information on installing specific goods, on request by e-mail or phone. After professional installation, the goods are used as an ordinary part of the vehicle and do not require any special operation by the buyer.
The seller recommends that the buyer inspect the goods immediately upon receipt (completeness, correct type and absence of damage) before their installation, and keep proof of installation if it was carried out by a garage; this makes it easier to assess a possible complaint, but presenting such proof is not a condition for making a complaint. The seller is not liable for defects caused by unprofessional installation, incorrect wiring or use of the goods contrary to their purpose, unless the installation was carried out by the seller or a person authorised by the seller, or the buyer installed the goods incorrectly because of shortcomings in installation instructions provided by the seller (Article X).
Road approval (type approval, E-mark). For lights and other lighting parts, the product page states whether they are type-approved (bear the “E” approval mark); if this information is missing for a product, the goods are not considered type-approved. Goods without type approval are not approved for use on a vehicle in road traffic and are intended for off-road use only; a vehicle fitted with them will not pass the roadworthiness test.
A buyer who is a consumer acquires ownership of the goods, and the risk of accidental loss of, damage to or deterioration of the goods passes to them, at the moment of delivery, i.e. when they or a third party designated by them (other than the carrier) take possession of the goods. A buyer who is not a consumer acquires ownership of the goods upon taking delivery of them, but not before the purchase price has been paid in full (retention of title); the risk of damage to the goods passes to them upon taking delivery of the goods.
The consumer may withdraw from a distance contract without giving any reason within 14 days of the day on which the consumer, or a third party other than the carrier indicated by the consumer, takes possession of the goods; if goods ordered in one order are delivered separately (e.g. in several shipments), the period runs from the day of taking possession of the goods delivered last. The deadline is met if the consumer sends the notice of withdrawal no later than on the last day of the period.
The right to withdraw from the contract without giving any reason under this Article belongs only to a buyer who is a consumer. A buyer who is not a consumer (in particular a legal person or an entrepreneur buying the goods in the course of their business) does not have this right by law; a return of the goods may be agreed with them individually.
The consumer may withdraw by e-mail to info@tuningovesvetla.sk, by letter to the seller’s registered office, or online using the “Withdraw from the contract here” function at www.tuningovesvetla.sk/en/returns/online. If the consumer withdraws online, the seller will without delay provide them by e-mail with an acknowledgement of receipt of the withdrawal, including its content and the date and time it was sent. The model withdrawal form below may be used, but it is not obligatory. Detailed information is on the Returns page.
The consumer must send the goods back or hand them over to the seller no later than 14 days from the day of withdrawal. The consumer bears the direct cost of returning the goods. Bulky goods that by their nature cannot be returned by post (in particular bumpers, body kits, fenders and hoods) are returned via a carrier; the direct cost of returning them from Slovakia is estimated at a maximum of approximately EUR 45 including VAT (usually EUR 15 to 35 depending on the weight and size of the shipment). The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
The seller will refund the consumer all payments received from the consumer under or in connection with the contract, including the costs of delivering the goods and the cash-on-delivery surcharge, no later than 14 days from the date of receipt of the notice of withdrawal from the contract. The seller is not required to reimburse the supplementary costs if the consumer expressly opted for a type of delivery other than the least expensive standard delivery offered by the seller; supplementary costs mean the difference between the price of the chosen type of delivery and the price of the least expensive standard delivery (personal pickup is not considered a standard delivery for this purpose). The seller will refund the payment using the same means of payment the consumer used, unless the consumer expressly agrees to a different means; in any event, the consumer will not incur any fees as a result. If the consumer paid cash on delivery or in cash and provides the seller with a bank account number (IBAN), the seller will refund the payment by bank transfer to that account (by providing the account number, the consumer agrees to this means of refund); otherwise the seller will refund it in cash or by another method the consumer agrees to. The refund is always free of charge for the consumer. The seller is not obliged to refund the payments before the goods are delivered back or before the consumer proves that they have sent the goods back.
The consumer cannot withdraw from the contract in the cases listed in Section 19(1) of Act No. 108/2024 Coll., in particular where the goods are made to the consumer’s specifications or made to measure (Section 19(1)(c) of that Act). This exception does not apply to goods from the store’s regular range, including parts designed for a specific vehicle model, goods marked “Available to order” that the seller orders from its supplier and second-hand (bazaar) goods, nor to a choice between variants offered in the store (for example left- or right-hand drive or colour).

If the buyer is a consumer, the seller is liable for any defect (lack of conformity) that the goods have at the time of delivery (when the buyer or a person designated by the buyer takes possession of them) and that becomes apparent within 24 months of delivery (the liability period for defects, i.e. the legal guarantee). A defect that becomes apparent within this period is presumed to have existed at delivery, unless the contrary is proven or this presumption is incompatible with the nature of the goods or of the defect. If the seller remedies a defect by repair for the first time, the liability period for defects is extended by 12 months; it is extended only once, regardless of the number of repairs. If a longer period is stated for specific goods, the longer period applies.
The EU harmonised notice on the legal guarantee of conformity (legal liability for defects) is published on the Your legal guarantee rights page (www.tuningovesvetla.sk/en/legal-guarantee), which is linked from every page of the online store; further information on legal guarantee rights is also available on the Your Europe portal (europa.eu/youreurope/guarantees).
Second-hand (bazaar) goods (used goods or returned goods, e.g. with opened or damaged packaging) are marked separately in the online store and their condition is described with the product. The seller is liable for their defects in the same way as for new goods; however, for used goods, wear corresponding to the extent of their previous use is not a defect.
For a buyer who is not a consumer (a legal person or an entrepreneur buying the goods for their business), the seller provides a quality guarantee of 12 months from taking delivery of the goods, and their rights arising from defects are governed by the Slovak Commercial Code; such a buyer must inspect the goods as soon as possible after receipt and notify the seller of any defects found without undue delay. Stating a company ID (IČO) in the order does not in itself mean that the buyer is not a consumer.
The seller is not liable for defects that arose after delivery from improper handling, mechanical damage or normal wear and tear. The seller is liable for a defect caused by incorrect installation or wiring only if the installation was carried out by the seller or a person authorised by the seller, or if the buyer installed the goods incorrectly because of shortcomings in installation instructions provided by the seller (Article VII). Installing the goods in the vehicle as such (removing the vehicle’s original parts, connecting the plug, adjusting the headlight aim) is not interference with the goods that would exclude the seller’s liability for defects. If the seller rejects liability on the grounds that the defect was caused by incorrect installation or by damage after delivery, the seller must prove it. If the buyer finds that the shipment was damaged in transit, we recommend contacting the seller as soon as possible after receipt and providing photos (including the packaging); this does not affect the buyer’s rights arising from liability for defects.
Details are set out in the Complaints Policy.
If the consumer is not satisfied with the way their complaint was handled or believes that the seller has infringed their rights, they have the right to contact the seller with a request for redress. If the seller rejects the request for redress or does not respond to it within 30 days of the date it was sent, the consumer has the right to file a motion to initiate alternative dispute resolution under Act No. 391/2015 Coll.
The competent body for alternative dispute resolution is the Slovak Trade Inspection (www.soi.sk), or another authorised legal entity entered in the list of alternative consumer dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic, if it is competent for the dispute; if more than one body is competent, the consumer may choose which one to approach. This does not affect the consumer’s right to go to court. A consumer residing in another EU Member State may also seek help with a cross-border dispute from the European Consumer Centre in their country (ECC-Net).
The seller processes the buyer’s personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 18/2018 Coll. on the Protection of Personal Data, in particular for the purposes of processing the order and performing the contract. Details about the processing of personal data are set out in a separate document, Privacy Policy.
Heureka “Verified by Customers” satisfaction questionnaire. Unless the buyer refuses it by ticking the box in the ordering process, after an order with delivery to Slovakia or the Czech Republic is submitted, the seller passes the buyer’s e-mail address, the order number and information about the purchased goods to Heureka Group a.s. (operator of the Heureka.sk comparison site) so that it can send a satisfaction questionnaire under the “Verified by Customers” programme, which helps the seller improve its services. With the same box the buyer can also refuse the seller’s request to review the purchased goods; the buyer can also refuse the questionnaire and the review request later via the link in the seller’s review request e-mail or by e-mail to the seller; the refusal also applies to further orders placed with the same e-mail address. An opt-out via the link in the e-mail from Heureka Group a.s. is recorded only by that company. Details are in the Privacy Policy.
The content of the online store — in particular the texts and product descriptions, photographs, graphic design, the structure and classification of goods by vehicle (so-called fitment) and the source code of the pages — is protected under Act No. 185/2015 Coll. (the Copyright Act), either by copyright or by the special right of the database maker. The rights to it are exercised by the seller, or the seller uses it under a licence from the persons entitled (in particular its suppliers). This does not apply to reviews and photos added by customers: the rights to them remain with their authors, and the seller publishes them with the consent of the author, who submitted them for publication in the online store.
Any copying, reproduction, downloading, storing in databases or other use of the content — including automated data collection (so-called scraping, crawling or data mining) and its use for training models — without the prior written consent of the seller is prohibited. The exception is ordinary browsing of the store by a customer and indexing by public search engines (e.g. Google, Zoznam, Bing) for search purposes. This prohibition does not apply to the author of a review in respect of their own text and photos.
In the event of an infringement of these rights, the seller is entitled to assert all claims arising from the Copyright Act and the Civil Code, including compensation for damages and the surrender of unjust enrichment.
The seller reserves the right to amend these terms and conditions; for a specific order, the wording in effect at the time it was submitted applies. If a provision of a later version of the terms and conditions, the complaints procedure or the information on withdrawal from the contract is more favourable to the consumer, the seller will apply it also to orders submitted earlier. The buyer receives the wording that applies to a specific order as an attachment to the order confirmation; the seller will also send it again by e-mail free of charge on request. Any invalidity of an individual provision does not affect the validity of the remaining provisions.
These terms and conditions take effect on 9 October 2026 at 4:30 (Slovak time) and apply to orders submitted from that moment; orders submitted earlier are governed by the wording in effect at the time they were submitted.
